These Terms of Service ("Terms") govern your access to and use of the Lollapalooza India Official Merchandise Store store.lollaindia.com, owned and operated by [Bookmyshow Live Private limited], a company/entity incorporated/registered under the laws of India ("we", "us", "our" or "Seller").

By accessing or using the Site, creating an account, or placing an order for any merchandise ("Merchandise"), you agree to be bound by these Terms, together with any other policies expressly incorporated into these Terms. If you do not agree to these Terms, please do not use the Site.

1. Eligibility

You must have the legal capacity to enter into a binding contract under applicable law to place an order on the Site. For customers below the applicable age of majority, the Site may be used and Merchandise may be purchased only with the involvement and consent of a parent or legal guardian.

By placing an order, you represent that the information provided by you is accurate and that you are authorised to use the payment method selected by you.

We reserve the right to refuse or cancel an order where we reasonably believe that the order has been placed in breach of these Terms or applicable law.

2. Products, Pricing, and Availability

All Merchandise displayed on the Site is subject to availability. Product descriptions, specifications, sizes, colours, images and other information are provided for general information and may be subject to minor variations, including variations arising from screen settings, lighting conditions and manufacturing processes.

We reserve the right to limit quantities, discontinue Merchandise, or modify product information and pricing from time to time. Any such modification shall not affect an order that has already been accepted and confirmed by us, except where the order is affected by a genuine pricing, technical or inventory error as set out below.

All prices shall be displayed in Indian Rupees (INR) and shall include applicable taxes unless expressly stated otherwise. Any applicable delivery or other charges shall be disclosed to you before completion of the purchase.

We make reasonable efforts to ensure that pricing and product information displayed on the Site is accurate. However, if Merchandise is listed at an incorrect price due to a technical, typographical or other manifest error, we reserve the right to cancel the affected order and provide a refund of any amount paid by you in respect of such order.

3. Order Acceptance

By placing an order on the Site, you make an offer to purchase the selected Merchandise at the price displayed at the time of placing the order.

Upon receipt of your order, we may send an acknowledgement confirming receipt of the order. Such acknowledgement does not, by itself, constitute acceptance of the order.

An order shall be considered accepted when we issue an order confirmation or otherwise expressly confirm acceptance of the order.

We reserve the right to refuse or cancel an order, in whole or in part, before dispatch in circumstances including, without limitation:

  • suspected fraud or unauthorised activity; 

  • violation of applicable law or these Terms; 

  • pricing or technical errors; 

  • unavailability of Merchandise; 

  • suspected commercial resale where the order is placed in breach of the applicable quantity restrictions; or 

  • circumstances beyond our reasonable control. 

Where payment has already been received for an order that is subsequently cancelled by us, the amount paid for the cancelled order shall be refunded to the original payment method, subject to applicable law and the provisions of the Return & Cancellation Policy.

Merchandise is intended primarily for personal use. We reserve the right to limit or cancel orders that reasonably appear to have been placed for commercial resale or bulk redistribution.

4. Payments

Payments made through the Site may be processed through third-party payment gateways or payment service providers. You agree to comply with the terms and conditions applicable to the selected payment method.

We do not require you to provide or disclose your complete payment card credentials to us. Payment credentials are processed by the relevant payment service provider in accordance with its applicable security and privacy practices.

By making a payment, you confirm that you are authorised to use the selected payment method.

We shall not be responsible for any failure, delay or interruption attributable solely to a payment service provider, banking institution or payment network, subject always to applicable law.

Where a refund is approved, the refund shall be processed in accordance with the Return & Cancellation Policy and applicable law.

5. Intellectual Property

The Lollapalooza® name, trademarks, logos, artwork, designs, graphics, photographs, product designs, text and other content displayed on the Site or embodied in the Merchandise are owned by, or used under licence from, their respective rights holders and are protected under applicable intellectual property laws.

Your purchase of Merchandise does not grant you any licence or other right to reproduce, manufacture, modify, distribute, publicly display, commercially exploit or otherwise use any intellectual property embodied in the Merchandise or displayed on the Site, except for personal, non-commercial use of the purchased Merchandise.

Any unauthorised use of such intellectual property may constitute an infringement of applicable law.

6. User Conduct

When using the Site, you agree not to:

  • provide false, inaccurate or misleading information; 

  • use the Site for any unlawful, fraudulent or unauthorised purpose; 

  • attempt to gain unauthorised access to the Site, its servers or connected systems; 

  • interfere with or disrupt the operation or security of the Site; 

  • use bots, scrapers, crawlers or other automated means to place orders or extract data, except where expressly authorised by us; 

  • circumvent any quantity, purchase or access restriction imposed on the Site; 

  • place orders for the purpose of fraud, abuse or unauthorised commercial resale; or 

engage in any conduct that violates applicable law or infringes the rights of any person.

7. Third-Party Links and Services

The Site may contain links to, or integrate with, third-party websites, payment gateways, logistics providers and other services.

Such third-party services may be subject to their own terms and privacy policies. We are not responsible for the independent content, availability, security or practices of third-party services, except to the extent required under applicable law.

Your use of any third-party service is subject to the terms applicable to that service.

8. Limitation of Liability

To the maximum extent permitted under applicable law, our aggregate liability arising out of or in connection with your use of the Site or any purchase made through the Site shall not exceed the amount actually paid by you for the specific Merchandise giving rise to the relevant claim.

To the maximum extent permitted under applicable law, we shall not be liable for indirect, incidental, special, exemplary or consequential losses arising from your use of the Site or purchase of Merchandise.

Nothing in these Terms shall exclude, restrict or limit any right, remedy, liability or protection available to a consumer under applicable law which cannot lawfully be excluded, restricted or limited.

Nothing in these Terms shall exclude or limit liability to the extent such exclusion or limitation is prohibited under applicable law.

9. Indemnification

To the extent permitted under applicable law, you agree to indemnify and hold us harmless from losses, claims, damages, liabilities and reasonable costs arising directly from:

  • your fraud or wilful misconduct; 

  • your unlawful use of the Site; 

  • your material breach of these Terms; or 

  • your infringement of the intellectual property or other rights of any third party. 

Nothing in this clause shall require you to indemnify us for losses arising solely from our breach of applicable law, negligence or wilful misconduct.

10. Force Majeure

We shall not be responsible for any failure or delay in performing our obligations under these Terms to the extent such failure or delay is caused by circumstances beyond our reasonable control, including natural disasters, governmental actions, acts of God, epidemics or pandemics, strikes, labour disruptions, transportation disruptions, interruptions of utilities or telecommunications, or failures of third-party service providers.

This provision shall not affect any rights or remedies available to consumers under applicable law.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India.

Subject to applicable consumer protection laws and any jurisdictional rights available to a consumer under applicable law, disputes arising out of or in connection with these Terms or any purchase made through the Site shall be subject to the jurisdiction of the competent courts at Mumbai India.

12. Changes to These Terms

We may amend or update these Terms from time to time. The updated Terms shall be published on the Site together with the applicable effective date.

Any amendments shall apply prospectively and shall not affect orders already accepted and confirmed by us, unless otherwise required or permitted under applicable law.

Your continued use of the Site after the effective date of an updated version of these Terms constitutes acceptance of the updated Terms to the extent permitted under applicable law.

15. Severability

16. Waiver

No failure or delay by us in exercising any right or remedy under these Terms shall constitute a waiver of that right or remedy.

17. Entire Agreement

These Terms, together with the policies and documents expressly incorporated herein, constitute the entire agreement between you and us in relation to your use of the Site and supersede prior representations or understandings concerning the same subject matter, except to the extent otherwise required under applicable law.
